All business that are involved in exporting that are the U.S. Principal Parties in Interest (those responsible for receiving payments or responsible for the sale of goods and services leaving the USA) as well as Freight Forwarders, Authorized Agents, Exporting Carriers and others must file documents for all shipments requiring shipper's Export Declaration (SED) information as per William G. Bostic, Jr., Chief of Foreign Trade Division The U.S. Census Bureau has issued the final rule activating provisions in the Foreign Relations Authorization Act, Pulbic Law 107-228 which amended Title 15, Code of Federal Regulations, Part 30, Foreign Trade Regulations (FTR) in its entirety. These new regulations have tougher penalty provision that affect everyone in the export process. Penalties may be imposed per violation from $1,100 to $10,000, both civil and criminal, for the delayed filing, failure to file, false filing of export information, and illegal activity. Filers are faced with new filing deadlines my mode of transportation for reporting export information. Seizure of commodities is possible if new electronic filings are not used.
